How Does Asset Protection and Exemption Work
Asset protection issues in bankruptcy revolve around the assets the filers are allowed to keep. That will depend on which exemptions you qualify for. A bankruptcy exemption allows a debtor to keep a piece of property that would otherwise be sold to pay creditors.
For example, in Chapter 7 bankruptcy, all the debtor’s non-exempt property is liquidated by a bankruptcy trustee to pay creditors. Exempt assets can be kept.
Bankruptcy is a product of federal statute. However, the laws that govern bankruptcy use state exemptions to determine which assets you can and cannot protect. These state law exemptions allow every resident to protect assets from the reach of creditors.
Exemption laws in California are a bit more complicated than in other states. You can use California exemptions if you have lived in California for two years before filing for bankruptcy. Federal exemptions are not available.
However, there are two sets of state exemptions. You have to choose between the exemptions outlined in sections 703 and 704.
Bankruptcy Exemptions – Section 704 includes the following protections:
- Up to $600,000 in equity in a home.
- Up to $4,850 in the value of vehicles.
- Jewelry, heirlooms, and works of art up to $8,725.
- Reasonably necessary household clothes, furnishings, and appliances.
Bankruptcy Exemptions – Section 703 includes the following protections:
- Up to $29,275 in equity in a home a filer lives in.
- Up to $7,500 in one or more vehicles.
- Up to $1,750 in jewelry.
- Any item of household goods, clothes, or furniture not exceeding $725 in value.
- Up to $1,550 in any property you own.
